1. Introduction

Welcome to KindGifts, a service provided by Aava, Inc. (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the KindGifts platform, including creating birthday pages, making contributions, and all related features.

By using KindGifts, you agree to these Terms. If you do not agree, please do not use the service.

3. The Service

KindGifts is a birthday giving platform that allows parents to create a birthday page for their child. Guests contribute money through the page, which is split between a charity chosen by the child and a birthday gift fund. Key aspects:

  • Creating pages is free. There is no cost to set up a birthday page.
  • Contributions are processed through Stripe in Canadian dollars (CAD) with a minimum of $10 CAD per contribution.
  • Funds are split according to the percentage set by the parent between the charity fund and the birthday gift fund.
  • Charity donations are facilitated by KindGifts on behalf of the parent after the birthday page closes.
  • Birthday gift funds are disbursed to the parent after the birthday page closes.

4. Eligibility

You must be at least 18 years old to create a birthday page or make a contribution. Birthday pages are created by parents or legal guardians on behalf of their children.

5. User Responsibilities

By using KindGifts, you agree to:

  • Provide accurate information when creating a birthday page or contributing
  • Only create birthday pages for children you are the parent or legal guardian of
  • Not use the platform for fraudulent or deceptive purposes
  • Not submit content that is offensive, harmful, or violates any law
  • Comply with all applicable laws and regulations

6. Contributions and Payments

  • All contributions are processed securely by Stripe. By making a contribution, you agree to Stripe's terms of service.
  • Contributions are non-refundable once processed, except where required by law or at our sole discretion.
  • We may charge a small service fee on contributions to cover payment processing and platform costs. Any applicable fees will be clearly displayed before you complete your contribution.
  • KindGifts is not a registered charity and does not issue tax receipts. The charity donation portion is submitted on behalf of the parent, and the receiving charity may issue a tax receipt directly to the parent.

7. Charity Donations

KindGifts facilitates donations to Canadian registered charities selected by the child (with parental approval). We make reasonable efforts to process donations promptly after a birthday page closes. However:

  • We do not guarantee that a specific charity will accept our donation or continue to operate.
  • If a selected charity is unable to receive funds, we will work with the parent to redirect the donation to a comparable charity.
  • KindGifts facilitates the donation process on behalf of the parent. Contributors give through KindGifts, and we handle delivering the charity portion to the selected organization.

8. Content

When you create a birthday page, you may provide a child's first name, age, charity story, and other content. You grant us a non-exclusive, worldwide license to display this content on the platform for the purpose of operating the birthday page.

Contributor names and birthday messages are displayed publicly on the event page. By submitting a message, you consent to its public display.

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be inappropriate.

9. Privacy

Your use of KindGifts is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Limitation of Liability

To the maximum extent permitted by law, Aava, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use KindGifts, including but not limited to loss of funds, data, or goodwill.

KindGifts is provided “as is” without warranties of any kind, either express or implied. We do not guarantee uninterrupted access or error-free operation.

11. Termination

We reserve the right to suspend or terminate your access to KindGifts at any time, with or without cause. If we terminate your access, we will make reasonable efforts to process any pending contributions and charity donations associated with your active birthday pages.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of KindGifts after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
